We hereby refer to your e-mail regardingthe delay of TG934/09FEB25 from Bangkok to Brussels.We are very sorry to learn of the unpleasant experience you encountered as a result of the delay of this flightbutThai Airways International bases these decisions on very high safety standards.
We have to inform that the delay was caused due toatechnicalproblem of the scheduled aircraft and all necessary steps has been done to find a replacement of this aircraft to avoid the cancellation of the flight. Unfortunately the last minute replacement of an aircraft requires many steps for preparation and reloading of all luggage and cargo and therefore caused a further delay for departure at 05.40 local time.We cannot change the negative experienceof this delay, however we would like to confirm that our airline has tried to offer the best service to our passengers during thisdelay.
After investigation of your case, we have to inform that according to the European law 261/2004 , the compensation foradelayed flight is not applicable for your case sinceEC261/2004 compensation law is not applied if it concerns a delay of more than 4 hours for adeparture in a city outside Europe (departure in Bangkok) andif it concerns a non-European carrier, which is the case for Thai Airways.We unfortunately haveto turndown your request for further liability and we are sorry to disappoint you in this respect.
